KUALA LUMPUR, 30 JULY, 2011: The RM1.08 billion Port Klang Free Zone (PKFZ) corruption trial involving former transport minister Tun Dr Ling Liong Sik will start on Monday.

The trial will be presided by High Court Judge Datuk Ahmadi Asnawi and 40 witnesses are expected to testify throughout the proceedings.

Dr Ling was charged July 29 2010 of cheating the Government of Malaysia by misleading the Cabinet on a land acquisition for the mega distribution hub project in Port Klang.

On the first count, Dr Ling is alleged to have deceived the Cabinet into agreeing to the terms of purchase between Kuala Dimensi Sdn Bhd (KDSB) and Port Klang Authority (PKA) and giving its approval for the purchase.

He was said to have committed the deception with the knowledge it could cause wrongful losses to the government and despite being bound by a fiduciary duty to protect the government.

The charge under Section 418 of the Penal Code carries a maximum sentence of seven years imprisonment or fine or both upon conviction.

Dr Ling faces an alternative charge of similar cheating for deliberately concealing facts related to the project from the Cabinet.

The charge under Section 417 of the Penal Code is punishable by imprisonment up to five years or fine or both upon conviction.

Dr Ling pleaded not guilty to both counts.

The PKFZ case will also embroil former transport minister Tan Sri Chan Kong Choy and former PKA general manager O.C. Phang.

Chan was charged and pleaded not guilty at the Putrajaya Sessions Court on Feb 28 on three counts of cheating former Prime Minister Tun Abdullah Ahmad Badawi on the PKFZ project.

Chan, 55 is alleged to have deceived Abdullah into approving KDSB as the turnkey developer for the Transshipment Hub at the Pulau Indah Free Zone and renovation works at the PKFZ site between 2004 and 2006 amounting to RM1.9 billion.

Phang was charged in the Klang Sessions Court on Dec 10, 2009 and pleaded not guilty to three counts of criminal breach of trust involving RM254.84 million.

Phang, 63 is alleged to have committed the breach of trust during her tenure as PKA general manager entrusted with funds in a RHB Bank Berhad account amounting to RM98,700,000 at PKA, Jalan Pelabuhan Utara, Port Klang between Oct 1, 2004 and Sept 5, 2005.

She faces two additional similar charges involving RM21,600,000 and RM134,550,000 at the same place between Sept 30, 2005 and May 9, 2006; and June 1, 2005 and Jan 13, 2006 respectively.

Chan's trial has been fixed for Sept 20 while Phang's was postponed to after Dr Ling's trial.
